Court Revokes AMCON-Appointed Receiver’s Powers Over GHL....

...... there was no Order but a purported receivership made unilaterally by AMCON but now vacated!

_In his ruling, the judge agreed with Obaigbena’s objection that the suit was an abuse of court process because of the prior existence of Suit No. FHC/L/CS/1903/2025 – General Hydrocarbons Limited against AMCON & 3 others._

A Federal High Court in Lagos has revoked the powers of the AMCON-appointed receiver over General Hydrocarbons Limited (GHL), ruling that the receiver's actions constituted an abuse of court process. 

The judge, Justice Adetayo Aluko, dismissed the suit and set aside interim orders made on October 24, 2025. 

 Justice Aluko agreed that the suit was an abuse of court process because a prior, substantive suit involving the same parties and issues was already before a different judge.

 The court found that the AMCON-appointed receiver and his counsel suppressed material facts and the existence of prior restraining orders from the other judge when they filed the new suit and obtained interim orders.

 The other judge had previously issued orders prohibiting AMCON and its agents from appointing a receiver over GHL and its assets.

 Justice Aluko stated that the actions of the receiver and his counsel undermined the credibility of the judicial process and wasted the court's time and resources. 

The ruling is seen as a significant victory for GHL in its dispute with AMCON.
